What is "Standard" Parenting Time
The most important element in fashioning a parenting plan is the best interests of the children. Many judges believe that 50/50 parenting time schedule (or close to it) is reasonable and in the best interests of the children. However, depending on the individual facts and circumstances of your case, a 50/50 parenting plan may or may not work for you and your children. The facts that judges tend to consider are such things as; work schedules of the parents, where the children go to school, day care, support from family and the location of other relatives, health issues, and the specific schedule (like sports or counseling or special needs) of the children.
Parenting Time Not Dependant on Legal Custody
Parenting time or visitation is not the same as Legal Custody, and is not dependent on whether a parent has sole or joint legal custody. For instance, a parent might have joint custody, but have an every other weekend style parenting plan. Or, a parent might have sole legal custody, but share a 50/50 parenting plan with the non-custodial parent. So if you're offered "joint custody" don't assume you will receive 50% parenting time. And, if you want "sole legal custody" don't think the other parent must settle for every other weekend.
