Discrimination and Retaliation

In Oregon, the overwhelming majority of employees are employed "at-will". This means that they can be fired ("discharged") for almost any reason - or for absolutely no reason at all. However, there are many exceptions to the general rule of at-will employment. These exceptions exist in the form of state and federal laws prohibiting discrimination and retaliation. Under federal law, Title VII prohibits discrimination based on race, color, national origin (nationality), gender, or religion (religious discrimination). The Americans with Disabilities Act (ADA) prohibits discrimination on the basis of disability; and the Age Discrimination in Employment Act (ADEA) prohibits discrimination on the basis of age. In addition to prohibiting discrimination as to the terms and conditions of employment (such as hiring, firing, promotion, and pay rate), these laws prohibit discriminatory harassment (including sexual harassment). They also prohibit employers from retaliating against employees who oppose these types of discrimination. State and federal laws provide for damages (payable to employees) for violation of these requirements

Wage & Hour

The federal Fair Labor Standards Act (FLSA) requires employers to pay their employees minimum wages, as well as "time-and-a-half" for all overtime hours worked in excess of forty hours per workweek. Oregon law contains similar standards, and also imposes requirements for break times and meal periods. Oregon law imposes additional requirements for the timely payment of wages upon termination of employment. These state and federal laws provide for substantial penalties (payable to employees) for violation of these requirements

Family Leave

The federal Family Leave Medical Act (FLMA) provides eligible employees up to twelve weeks of family leave per year. The Oregon Family Leave Act (OFLA) provides similar rights. In addition to providing for family leave, these laws prohibit discrimination or retaliation against employees who exercise their right to family leave. These state and federal laws provide for substantial penalties (payable to employees) for violation of these requirements.
