What is "Standard" Parenting Time

The most important element in fashioning a parenting plan is the best interests of the children. A 50/50 parenting time schedule (or close to it) may be reasonable and in the best interests of the children. This is especially true in low conflict cases with effective co-parenting. However, depending on the individual facts and circumstances of your case, a 50/50 parenting plan may or may not work for you and your children. The facts that judges tend to consider are such things as; the ages of the children, work schedules of the parents, where the children go to school, day care, support from family and the location of other relatives, health issues, and the specific schedule (like sports or counseling or special needs) of the children.

Parenting Time Not Dependant on Legal Custody

Parenting time or visitation is not the same as Legal Custody, and is not dependent on whether a parent has sole or joint legal custody. For instance, a parent might have joint custody, but have an every other weekend style parenting plan. Or, a parent might have sole legal custody, but share a 50/50 parenting plan with the non-custodial parent. So if you're offered "joint custody" don't assume you will receive 50% parenting time. And, if you want "sole legal custody" don't think the other parent must settle for every other weekend.

The Winning Edge - Have a Team Working For You

There are a lot of family law attorneys in Oregon, but we offer something that many other attorneys can’t.

Our entire family law team, including lawyers and paralegals, meet regularly to review our new clients’ cases and the important developments in ongoing cases. We discuss what different Judges are ordering for support and custody, analyze what the newest Court of Appeals decision may mean to your situation, and sometimes debate how to best deal with opposing counsel. Collaboration, second and third opinions, shared knowledge, brainstorming innovative solutions. It’s something not every attorney can offer.
